Da Justiça alternativa em Portugal

Abstract

Um sistema jurídico e a governança da Justiça devem representar uma projeção do contexto social, histórico, económico e político no plano material e formal. Nessa medida, importa analisar os fatores que têm vindo a precipitar, na sociedade portuguesa, a consolidação do universo de respostas emergentes e alternativas à Justiça clássica, sobretudo desde o início do século XXI, comummente designadas como meios de resolução alternativa de litígios, por forma a compreendermos os desafios que se colocam, atualmente, aos cidadãos e aos operadores do Direito.A legal system and the governance of justice must represent a material and formal projection of the social, historical, economic and political context. To that extent, it is important to analyze the factors that have precipitated, in Portuguese society, the consolidation of the universe of emerging and alternative responses to conventional Justice, especially since the beginning of the 21st century, commonly referred to as alternative means of dispute resolution to understand the challenges that are currently facing citizens and operators of law.
