Resumo
Os incidentes táctico-policiais são um fenómeno pouco frequente em Portugal e cuja problemática não é muito debatida. Contudo eles acarretam problemas tanto a nível jurídico como a nível mediático.
Para agilizar os procedimentos de cooperação em ocorrências que implicam a intervenção de várias forças e serviços de segurança, foi criado um Plano de Coordenação, Controlo e Comando Operacional das Forças e Serviços de Segurança. O Anexo A deste diploma destina-se a regular, exclusivamente, a gestão de incidentes táctico-policiais.
Os órgãos de comunicação social, para garantirem a direito à informação constitucionalmente consagrado, possuem direito de acesso às fontes de informação. Este inclui um direito de acesso a locais públicos para fins de cobertura mediática. Consequentemente, os jornalistas podem estar presentes no local onde decorre um incidente táctico-policial.
A cobertura mediática implica uma captura de imagens e gravações que podem pôr em causa o direito à imagem dos visados. No entanto, os órgãos de comunicação social estão sujeitos a sanções jurídicas no âmbito disciplinar e criminal caso infrinjam certas normas às quais estão subordinados.
Tactical-police incidents are an unfrequent phenomenon in Portugal and its problematic is not much discussed. However they bring out problems at legal and media level. In order to smooth cooperation procedures in occurrences which implicate the intervention of multiple forces and security services, a Plan of Coordination, Control and Operational Comand of Forces and Security Services has been created. Attachment A of this diploma has the purpose of regulate, exclusively, the management of tactical-police incidents. Social communication organs, in order to guarantee the right to information constitutionally consecrated, have the right to access sources of information. This includes the right to access public places for means of media convering. As a consequence, journalists can be present in the local where the tactical-police incident takes place. Media coverage implies the capture of images and recordings that might put in cause the right to image of the targeted. However, social communication organs are subject to legal punishment in both criminal and disciplinay sphere if they break certain dispositions to which they are subject.
