Resumo
O fim da Guerra Fria e as fortes reduções dos orçamentos de Defesa dos Estados
refletiram-se, entre outras consequências, numa diminuição da procura de armamento e
profunda reestruturação do setor.
Constituindo-se o setor industrial ligado à Defesa como um dos elementos cruciais no
desenvolvimento tecnológico de um país, tem-se assistido a uma preocupação cada vez
maior da Europa em promover as Indústrias de Defesa nacionais nos fora internacionais.
Não sendo Portugal alheio a esta realidade, este estudo teve por objetivo propor uma
alteração ao edifício legislativo que regula as aquisições de bens e serviços no âmbito da
Defesa.
Recorrendo à análise da legislação europeia e nacional em matéria de transação de
bens militares, e do conteúdo das oito entrevistas realizadas a peritos nesta área – e
considerando que existe vontade política e recursos financeiros que possibilitam dotações
para a Indústria de Defesa – concluiu-se que, similarmente ao já realizado por outros Estados
Membros, Portugal deverá transpor para o seu edifício legislativo a Diretiva n.º 2009/81/CE,
de 13 de julho, que prevê a salvaguarda das Indústrias de Defesa Nacionais aquando da
coordenação dos processos de adjudicação nos domínios da Defesa e Segurança. Neste
enquadramento, são ainda apresentadas propostas concretas de alterações legislativoprocedimentais
The end of the Cold War and the dramatic reductions of states defence budgets reflected, among other consequences, in a decrease in the demand for arms and a deep restructuring of the defence industry sector. As this sector is considered crucial in the technological development of a country, Europe has become increasingly concerned about promoting national defence industries in international fora. As Portugal is not oblivious to this reality, this study aims to propose an amendment to the legislative office that regulates the acquisition of goods and services in the field of defence. With the analysis of National and European legislation on the transaction of military goods, and the results of the eight interviews carried out with experts in this area – whilst assuming the existence of political will and financial resources that allow budgetary resources for the defence industry - it was concluded that, in a similar manner to other Member States, Portugal must transpose Directive N.º 2009/81/CE, of 13 July into its own legislation thus providing for the safeguard of National Defence Industry when coordinating defence and security procurement procedures. Within this framework, concrete proposals for legislative-procedural amendments are also presented
